This policy outlines the official procedures for submitting copyright infringement notices and counter-notices, ensuring our platform remains compliant and fair to all users and rights holders.

1. Our Commitment to Copyright Compliance

• Responding promptly to all valid DMCA notices.
• Removing or disabling access to infringing content as required by law.
• Taking necessary action against repeat offenders.

We maintain processes that strictly align with DMCA Section 512.

2. What Constitutes Copyright Infringement?

Copyright protects original works of authorship, which includes, but is not limited to: product photographs, website text, product descriptions, graphic designs, logos, artwork, videos, and original patterns. Unauthorized reproduction, display, or distribution of these works constitutes infringement.

3. Filing a Valid DMCA Takedown Notice

If you believe material on suiteroket.com infringes your copyright, you (or your authorized agent) must submit a formal DMCA Takedown Notice. To be valid and processed quickly, the notice must include the following elements:

1. Physical or Electronic Signature: Your full legal name and a physical or electronic signature.
2. Identification of the Copyrighted Work: Clear identification of the copyrighted work claimed to have been infringed (e.g., copyright registration number, publication link, or detailed description).

4. Processing of DMCA Notices

Upon receipt of a complete notice, Suiteroket follows the DMCA statutory requirements:

1. Review and Verification: We verify the claim and the provided evidence of ownership.
2. Removal Action: If the notice is found valid, we will promptly remove or disable access to the identified infringing material.
3. Notification: We notify the user who uploaded the content about the action taken.

5. DMCA Counter-Notice Procedure

If your content was removed pursuant to a DMCA Takedown Notice and you believe the removal was a result of mistake or misidentification, you may submit a Counter-Notice.

A valid Counter-Notice must include:

1. Identification: Identification of the material that has been removed and the URL location where the material appeared before it was removed.
2. Consent to Jurisdiction: A statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the U.S., any judicial district in which Suiteroket may be found).
3. Acceptance of Process: A statement accepting service of process from the person who provided the original DMCA notice.
4. Perjury Statement: A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
5. Signature: Your full legal name and physical or electronic signature, and full contact information.

If a valid Counter-Notice is received, we may restore the content within 10 to 14 business days, unless the original complainant files a court action seeking a court order to restrain the user from engaging in the infringing activity.

6. Repeat Infringer Policy

Suiteroket maintains a zero-tolerance policy toward repeat infringement. Users or accounts that are found to repeatedly upload infringing content will have their access permanently restricted or terminated.

7. Misrepresentation and Bad-Faith Claims

Any person who knowingly materially misrepresents that content is infringing, or that content was removed by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees. We reserve the right to pursue all remedies against fraudulent claims.
