  1. What Constitutes Copyright Infringement?

  1. Filing a Valid DMCA Takedown Notice

  1. Processing of DMCA Notices

Upon receipt of a complete notice, Suiteroket follows the DMCA statutory requirements:

  1. Review and Verification: We verify the claim and the provided evidence of ownership.
  2. Removal Action: If the notice is found valid, we will promptly remove or disable access to the identified infringing material.
  3. Notification: We notify the user who uploaded the content about the action taken.
  1. DMCA Counter-Notice Procedure

If your content was removed pursuant to a DMCA Takedown Notice and you believe the removal was a result of mistake or misidentification, you may submit a Counter-Notice.

A valid Counter-Notice must include:

  1. Identification: Identification of the material that has been removed and the URL location where the material appeared before it was removed.
  2. Consent to Jurisdiction: A statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the U.S., any judicial district in which Suiteroket may be found).
  3. Acceptance of Process: A statement accepting service of process from the person who provided the original DMCA notice.
  4. Perjury Statement: A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  5. Signature: Your full legal name and physical or electronic signature, and full contact information.

If a valid Counter-Notice is received, we may restore the content within 10 to 14 business days, unless the original complainant files a court action seeking a court order to restrain the user from engaging in the infringing activity.

  1. Repeat Infringer Policy

Suiteroket maintains a zero-tolerance policy toward repeat infringement. Users or accounts that are found to repeatedly upload infringing content will have their access permanently restricted or terminated.

  1. Misrepresentation and Bad-Faith Claims

Any person who knowingly materially misrepresents that content is infringing, or that content was removed by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees. We reserve the right to pursue all remedies against fraudulent claims.
